Cooper & Kowalski Secures Unanimous 45-Minute Defense Verdict

Toledo, OH – Another significant victory for a Cooper & Kowalski trial team.
Gerry Kowalski and Sarah Skow recently defended a well-respected local physician in a medical malpractice action brought by a former patient. After a four-day trial, the jury deliberated for only 45 minutes before finding unanimously in favor of the physician.
Plaintiff alleged that the physician, who was treating the patient for high blood pressure and hair loss, violated the prevailing standard of care by prescribing medication that should not have been used with the patient’s existing medication. The jury agreed that the physician's treatment of the patient was well within the applicable standard of care, and it returned what is thought to be one of the quickest defense verdicts in a medical malpractice case in Lucas County.
One of the keys to showing the jury the care that the physician provided was the firm's Trial Director Software. It allowed the jury to view all of the doctor's office notes while the doctor testified. Commenting on the effectiveness of Trial Director, Sarah Skow said: "The jury easily follows testimony from the witness stand with its ability to quickly highlight and blow up portions of key documents."
